COGAN PUTNAM VALLEY, NEW YORK ISSUE #8 FEBRUARY 21, 1995 Given the reaction of the defeated members of the United States Congress, President Clinton, the various political experts and the mass media of this nation to the events surrounding the unprecedented rea- lignment of the Congress last November, one might get the impression that the repudiation of the big government-grandiose social engineering- big taxes legislative body of the previous Congress was due to the efforts of the "gun lobby" bloc alone. President Clinton, in two sepa- rate interviews with the mass media in Cleveland, Ohio, blamed the National Rifle Association and the "gun lobby" for the loss of 20 seats in the House of Representatives, an idea has been reiterated in one way or another by other political pundits and the mass media as the near- sole cause of the defeat of the formerly largely Democratic Legislature and Admin- istration. Law abiding gunowners who made the effort of making their views known by casting their votes can certainly take some pride in knowing that they were part of a phalanx which sent the clear message to the central powers-that-be that they are unwilling to toler- ate any further erosion of the rights of individuals and the states they live in by an increasingly removed, thought-tight central State, and are in all likelihood directly responsible for the toppling of the sitting speaker of the House of Representatives, Thomas Foley (an event that last occurred in 1856); however, the assignment of "sole blame" for the composition of the 104th Congress is, in the final analysis, somewhat exaggerated, and the sense of accomplishment all law-abiding, gunowning voters are entitled to feel at the turn of events should be tempered by the reality that there are significant forces still in place whose agenda is the abolition of lawful gun ownership in America. All lawful gunowners and the groups they have joined to fight for their liberties do indeed have the right to gloat in the aftermath of the 1994 elections. In the aftermath of the passage of laws like the Brady Law and the Omnibus Crime Bill of 1994 which contained the ban on over 200 semiautomatic rifles and other firearms (the so-called "assault weapons" b an), a consensus of opinion developed which termed pro-gun rights groups like the National Rifle Association (and the people who make up their membership) as paper tigers, unable to affect either the decisions or the careers of the professional politicians in our national and state capitols, an assertion which was quickly and repeatedly broad- cast by the mass media in the United States. Ignored in this is the fact that, just prior to the enactment of both the Brady Law and the "assault weapons" ban, huge numbers of ordinary, law-abiding citizens expressed their concern- and their contempt--for both of these new laws (and the lawmakers who enacted them) by engaging in what amounted to a buying spree of the guns which would be affected by those same laws; at the same time pro-gunowner rights groups like the National Rifle Asso- ciation enjoyed an remarkable influx a new members which strengthened their financial bases and their political clout. Some suggested that the National Rifle Association, Gun Owners of America, the Second Amendment Foundation, et al., would be wiser to adopt compromise with the anti-gun ownership clique, arguing that it would be best to preserve some of the lawful gunowners' rights then to lose all to hostile legislators and a hostile administration; the pro-gunowner rights groups instead con- centrated on a grassroots political campaign which urged all active members to participate in the democratic process and encourage other gunowners to do so, using electronic media to inform and support the efforts of the individual citizens involved. The efforts of the individual gunowning voter on November 8, 1994, in combination with a phalanx of other, largely conservative groups, transformed the political establishment in Washington, changed the political climate in 28 of the 50 states, and left the mass-media elite of America open-mouthed in stunned astonishment. It is appealing to think that voting gunowners, informed and abetted by pro-gunowner rights groups, were the hand which helped topple the pedestal upon which the Democratic- controlled U. S. House of Representatives and Senate, and there is empirical evidence that gunowners are at least partially responsible to that end-- certainly the mass media, in their effort to "explain" the result of the November elections pointed towards gunowners and the organizations that lobby for them as the cause of their favorite candidate's defeat: "As candidates who backed gun control legislation fell one by one across the nation Tuesday night, the National Rifle Association reemerged as a high-caliber political force that politicians cross at their own peril." --The Hill, a Washington political publication, 11/10/94. Such statements are a candid if belated admission of the strength of the pro-gunowner rights movement in the United States, all previous opinion to the contrary; these same statements also serve, in the liberal ether in which the mass media and their favorite causes exist, as an accusation against that same pro-rights movement against what is termed "reasonable" gun control--and a warning to all law-abiding gunowners that the fight to preserve their rights and to reverse the ridiculous provisions of supposed "crime control" measures like the five-day national waiting period and the ban on firearms with semiautomatic actions and "excess" magazine capacities is still an uphill one. The new Congress, under the leadership of Senator Robert Dole and Speaker of the House Newt Gingrich, does represent a sea change (to borrow an overused word currently in vogue among the current occupants of the White House) in the government of this country, a change echoed in the partial to total shift of control in 28 state governments. It is to be expected that the unseating of the party which is principally responsible for much of the modern gun control laws in the United States is inimically beneficial to gunowning citizens; this good news is exem- plified in a personal letter sent by Speaker of the House of Representa- tives Newt Gingrich to Tanya Metaska, Executive Director of the National Rifle Association Institute for Legislative Action (NRA/ILA), in which Mr. Gingrich (R-GA) affirmed that, as long as he is Speaker of the House, "no gun control legislation is going to move in committee or on the floor of the House (of Representatives)", and he emphasized that his intention as Speaker is also to "remove ill-conceived and unnecessary government interference in those (Second Amendment) rights"; additional- ly, leaders of the NRA met with the Republican leadership in Washington, where they received a commitment to work for "a coherent Second Amen- dment strategy to define gun ownership as a Constitutional right." According to the information released via the NRA-ILA Fax Network (2/3/95), this is the first time in American history that any Speaker of the House has ever committed himself to such support of the individual citizens' Second Amendment rights. This is happy news to America's gunowners, who have suffered one gun control ("crime control") law after another, but a friendly leadership in the Government does not necessarily mean the provisions of the Brady Law or the "assault weapon" ban will be repealed anytime soon--and certainly not without the continued and unwavering support of the gunowning voter. One of the repeal bills is HR 698, sponsored by Representative Jim Chapman (D-TX), which currently has some 50 co-sponsors, and HR 424, introduced by Representatives Roscoe Bartlett (R-MD) and Steve Stockman (R-TX). Both proposals are in the process of being combined into one, and both are endorsed by pro-gun rights groups like the National Rifle Association and the Citizen's Committee on the Right to Keep and Bear Arms. The House leadership has also promised to hold a series of oversight hearings on federal law enforcement abuses, especially those abuses committed under the auspices of the Bureau of Alcohol, Tobacco and Firearms (BATF). Speaker Gingrich has threatened to defund any federal agency which has turned rogue and has abused its power. They have also promised to grant pro-gun rights representatives and experts equal time in hearings and in testimony on gun control issues, an important statement for all gunowners, as it means our point of view will have equal weight when any gun control, "crime control" law is considered. Some specific, lawful gunowner-friendly bills submitted in the 104th Congress include: HR 659--Rep. James Oberstar (D-MN), a bill to amend title 18, US Code, to permit Federal Firearms Licensees (FFL holders) to conduct firearms business with other such licensees at out-of-state gun shows. (Cmte. on the Judiciary) Rep. Roscoe Bartlett (R-MD), with 32 co-sponsors, a bill to protect the right to obtain firearms for security, and to use firearms in defense of self, family, or home, and to provide for the enforcement of such rights. (Cmte. on the Judiciary) H. Concurrent Resolution 5--Rep. Philip Crane (R-IL), a concurrent resolution expressing the sense of the Congress with respect to the rights of all Americans to keep and bear arms in defense of life or liberty, and in the pursuit of all other legitimate endeavors. (Cmte. on the Judiciary) Alas, the anti-gunowner rights forces are still hard at work in the Congress. President Clinton has promised to veto ANY bill which contains provisions that "weaken" or repeal the "assault weapon" ban. Some examples: HR 915, the "Firearms Safety and Violence Prevention Act of 1995" -- Rep. Charles Schumer (D-NY), fresh from his denunciation of the high- tech, hyperbarically promoted--and then nonexistent-- "Black Rhino" ammunition, has introduced a bill to EXPAND the powers of the BATF to "regulate the manufacture, distribution and sale of firearms and ammuni- tion" and to expand the jurisdiction of the BATF to include "firearm products and non- powder firearms", placing the manufacture, sale and ownership of BB guns and air guns under Federal control; "restrict the availability of weapons that pose an unreasonable risk of death and injury...[or] that pose a threat to public safety" by "developing safety standards for firearms and related products". (Cmte. on the Judiciary) HR 492--Rep. Fortney Stark (D-CA), a bill to impose a tax and import controls on bullets "expressly designated to penetrate law enforcement personnel bullet-proof vests". (Cmte. on Ways and Means) HR 385--Rep. James Traficant (D-OH), to establish a commission respon- sible for making recommendations for laws "that will control crime" and formulating "a national firearms policy without denying Second Amendment rights". (Cmte. on the Judiciary) HR 169--Rep. Cardiss Collins (D-IL), a bill to provide for the manda- tory registration of handguns. (Cmte. on the Judiciary) HR 174--Rep Cardiss Collins (D-IL), a bill to provide for the manu- facturer, importer or dealer of a handgun or "assault weapon" to be "held strictly liable" for damages that result from the use of the handgun or "assault weapon". (Cmte. on the Judiciary) HR 221--Rep. Peter Deutsch (D-FL), co-sponsored by Lantos (D-CA), Meehan (D-MA), and Pallone (D-NJ), a bill to amend title 18, US Code, to regulate the manufacture , importation and sale of "polymer plastic ammunition". (Cmte. on the Judiciary) HR 250--Rep, Louis Gutierrez (D-IL), a bill to prohibit the possession or transfer of "non-sporting" handguns. (Cmte. on the Judiciary) HR 444--Rep. (Cmte. on the Judiciary) Senator Daniel Patrick Moynihan (D-NY) has filed the following three bills dealing with ammunition: S 20--a bill to amend title 18, US Code, with respect ot the licensing of ammunition manufacturers and for other purposes. (Cmte. on the Judiciary) S 188--A bill to amend chapter 44 of title 18, US Code, to prohibit the manufacture, transfer or importation of .25, .32, and 9 mm. ammuni- tion. (Cmte. on the Judiciary) S 122--A bill to prohibit the use of certain ammunition, and for other purposes. (Cmte. on the Judiciary) When such polarized viewpoints are expressed within one legislating body, the most likely result of any debate on either new or existing gun control laws, when combined with an Executive hostile to gunowners' rights which will inevitably be abetted by the elite mass-media which has championed gun control for decades, is stalemate. Steven A Silver, Vice President and founding member of the Lawyer's Second Amendment Society (LSAS), expressed the difficulty well: "While new 'gun control' may be unlikely, it is equally unlikely that existing 'gun control' will be loosened or repealed. A repeal of the Brady Bill or the 'assault weapon' ban was conspicuously absent from the Republicans' 'Contract with America'. More importantly, President Clinton would almost certainly veto any such legislation and it seems unlikely Congress could override such a veto...our opponents take the long view of the battle to infringe our civil rights...they...recognize that over the past 30 years, 'gun control' had gone in only one direction: more repression and more restrictions...quite simply, despite the occasional setback to our opponents, Americans will continue to face ever stricter 'gun control' until and unless the right to keep and bear arms, guaranteed by the Second Amendment, is formally recognized by the Supreme Court as an individual right. This can be done at the grassroots level--where American gunowners enjoyed some success in the 1994 elections. Our best armament against the shrill emotionalisms and traditional power of the anti-gun rights clique are facts, honesty, preparation, and respect for any opposing point of view. Anything You Can Do, I Can Do Better: The "New" Gun Control Proposals in Albany The newest legislative session is looking from the law-abiding gunowner's point of view a great deal like the previous one. According to the New York State Senate Internet Gopher connection, the following bills have been referred to the codes committee in Albany: S1274--Prohibits the sale of ammunition to anyone other than Federal Firearms License (FFL) holders, farmers, gun-shooting club members and those involved in the military or the government. It is marked as having 8 sponsors as of 2/9/95. A1580 (30 "multi-sponsors" as of 1/24), S705 (prefiled with 15 sponsors as of 1/4), and S2146 (1 sponsor as of 2/8) All of these proposals are variations on the same theme as the Roberti- Roos "assault weapon" ban enacted in California and the national ban which was part of the Omnibus Crime Bill of 1994. Highlights include a a ban of a long list of firearms by name, and a ban of magazines holding more than 9 rounds and shotguns holding more than 5 rounds. Sound familiar? S152--Bans any firearm magazine capable of holding more than 9 rounds, requires a license to "carry, possess, repair, or dispose" of firearms, requires a license to own or carry a handgun, requires state approval to purchase a rifle or shotgun, and requires that a form be filed whenever any gunowner either accidentally or purposely discharges a firearm anyplace than at a shooting range or competition, or by a licensed hunter. It has 6 sponsors as of 1/4. The "assault weapon" ban and the restrictions on the sale of ammunition appear to be the most important (that is, the most likely to pass) at this time. The ban on any gun magazine with a capacity of greater than 9 rounds is the most restrictive to ever be proposed. FAST FACTS Information to Educate the Anti-Gun Rights Clique One of the provisions of the so-called "Brady II" gun control law is that any individual who wishes to engage in the trade of selling or repairing firearmsmust have "a place of business" which is wholly sepa- rate from their ordinary domicile or other location where they had conducted business in the past. The argument for emplacing such a restriction is twofold: having a "place of business" which is dedicated solely to the business of engaging in the sale, trade or repair of firearms makes periodic inspection by law enforcement agencies such as the Bureau of Alcohol, Tobacco and Firearms (BATF) easier, and to prev- ent a gunrunner equipped with an Federal Firearms License (FFL) from "selling guns from the back of a truck". Of course, it can also be said that the reason to impose such a law on law-abiding gun dealers and gunsmiths is to ensure that they suffer more financial hardship than any other businessperson as punishment for engaging in so nefarious a busi- ness as the sale or repair of guns to lawful citizens, and to prevent any dealer from doing business at gun shows, flea markets or auctions in buildings or locations which are not solely dedicated to the trade, because these "non-dedicated" locations are hotbeds of illegal activity, especially gunrunning to drug gangs and street thugs! Unfortunately for the anti-gun rights clique, the basis for the argument in favor of such an onerous and harassing law is by and large invented out of whole cloth.
